No Indian Casinos

There are no Indian casinos, Indian bingo halls or Indian gaming in Pennsylvania.

However there are two Native American tribes that own and operate gambling facilities in the state. Both are licensed and regulated by the Pennsylvania Gaming Control Board as commercial gaming operations. Neither is controlled by the U.S. Department of Interior.

The first tribe to invest in Pennsyslvania was the Mohegan Tribe of Connecticut. It owns and operates the Mohegan Sun Pocono, a casino and racetrack located outside Wilkes-Barre, Pennsylvania. the tribe purchased the property January 25, 2005.

The second tribe to invest in Pennsylvania was the Poarch Creek Indian Tribe of Alabama. In May 2019 the tribe purchased the Sands Bethlehem for $1.3 billion and renamed it the Wind Creek Bethlehem. This is a state-licensed, commercial casino rather than a federally regulated Indian casino. it is managed and operated by Wind Creek Hospitality, the casino and entertainment operation of the Poarch Creek Indian Tribe.

State-Licensed Casinos

The Pennsylvania Gaming Control Board was created in 2004 to regulate slot machines and casino gambling in the state. Table games were added in July 2010.

The gaming board has licensed 11 slot machine casinos to operate in the state. Three of these casinos are Harness Race Tracks and three others are Thoroughbred Race Tracks.

Two casinos were existing hotel resorts, which are limited by the law to operate a maximum of 600 slot machines. All others can have up to 5,000 slot machines. The board is authorized to license another three casinos.

2017 Expanded Gambling Act

A new gambling law passed by the legislature and signed by the governor in October 2017 which greatly expands legalized gambling throughout the state. The provisions of the law include:

  • Satellite Casinos
    The state will accept licensing bids from the ten larger casinos starting at $7.5 million. A successful bidder can then build a satellite casino with up to 750 slot machines and 30 game tables. The location cannot be within 25 miles of another casino or in county or city that prohibits it.
  • Online Gambling
    Websites and phone apps can offer online slots, poker, and table games to Pennsylvania residents. The license fee is $10 million.
  • Online Sports Betting
    Sports betting can be offered online or at the casino if the law is federally approved. The license fee is $10 million. Betting in fantasy sports is approved and will be taxed and regulated for the state. Players must be at least 18 years of age with verified proof.
  • Airport Gambling
    Gaming may also take place at airports as long as they are approved by the airport authority. Passengers with boarding passes would be allowed to access the games. They would be located at the state's regional or international airports.
  • Truck Stops
    Some truck stops can qualify for gambling and operate 5 video gaming terminals.
  • Lottery
    Keno and online games can also be offered by the Pennsylvania Lottery.

Pennsylvania Launches Online Casino Gambling

July 15, 2019

Today the first online casinos in Pennsylvania were launched at two casinos. Hollywood Casino at Penn National Race Course was the first by taking bets at 11AM. Parx Casino in Bensalem followed a few hours later. SugarHouse Casino will launch its gaming website on Wednesday.

In addition to being the first online Hollywood Casino was also first in the state to offer sports betting last November when it became legal.

Hollywood Casino's online games include slot machines, blackjack, roulette and craps. Live poker will follow soon when final approval is issued by the state.

The Pennsylvania Gaming Control Board was given licensing and regulatory authority over the state's online casinos on Oct. 26, 2017 after Gov. Tom wolf signed Bill H 271 to expand all gambling.

2021 will be a busy year for Pennsylvania. With both real money PA casinos and poker sites already online, you can expect new games, new promotions and new operators to expand in the Keystone State.

The initial licenses are awarded to holders of existing gaming licenses (brick and mortar casinos). A second batch awarded to ‘qualifying gaming organizations’ bringing increased choice for players further down the line.

Many big brand names including Scientific Games and PokerStars have already found partners – and have launched. While some live casinos declined to move online (for example Sands Bethlehem), other big names including Harrah’s Casino and Mohegan Sun are all posed to make this move.

Slots are taxed differently to table games and poker in PA. With a 54% tax on gross gaming revenues, these games will not be as profitable for the casinos as in other states. PA Online Gambling: The Road to Regulation

Like many East coast states, Horse Racing, and the gambling associated with them, were popular as far back as the 1830’s. A lottery and limited charity gambling options were all that was available for a long stretch – until 2004.

In that year ‘Act 71’ was passed, legalizing live casinos and betting at horse racing tracks. These forms of gambling would become a big source of income for the state coffers. High tax rates (particularly on slot and casino gaming), meant that more tax revenue came from gambling in PA than in any other state in 2018. This includes Nevada, where the revenues are higher – though tax rate is significantly lower.

On Oct. 25, 2017, the Pennsylvania Senate passed a comprehensive gaming expansion package that includes online gambling in the form of online poker, online slots, as well as online table games. The next day, the PA House passed the bill as well, making Pennsylvania the fourth state in the nation to authorize online gambling.

The package then went to Gov. Tom Wolf, who signed the bill on Oct. 30, 2017, officially cementing PA’s status as the fourth US state to legalize online gaming.

The legislation, H 271, permits a variety of other gambling expansions, including daily fantasy sports, sports betting both online and off (should the federal government repeal PASPA), video gaming terminals (VGTs) in authorized truck stops, and tablet gaming at qualified airport locations.

Now that Wolf signed the bill into law, it will likely be around nine months before the first legal online gambling sites launch in Pennsylvania. Regulations will need to be promulgated, licenses issued, sites tested, and so forth.

When legal NJ online gambling was passed, it was roughly nine months before sites went live.
